BANKRUPTCY PETITION PREPARERS

Section 110 of the United States Bankruptcy code provides that a non-attorney can assist in the preparation of the bankruptcy petition. The United States Trustees Office job is to enforce this code. 

Individuals can file bankruptcy without an attorney, which is called filing pro se. If you file bankruptcy pro se, you may be offered services by non-attorney petition preparers. According to regulations, preparers are restricted to entering data into forms and are forbidden from offering legal advice, explaining responses to legal inquiries, or assisting in bankruptcy court proceedings. A petition preparer is obligated to sign all documents they prepare for you, provide their name, address, and social security details on the documents, and secure you with copies of all documents. However, they are not allowed to sign documents on your behalf or accept payment for any court fees.
